The Brown County Courthouse shared with media outlets on Wednesday afternoon the following release from the State Commission on Judicial Conduct, dated Feb. 19:
Be it known that on November 25, 2025, the State Commission on Judicial Conduct suspended the Honorable Alan Shane Britton, County Judge for Brown County, Texas, following his November 20, 2025 indictment handed up by the duly constituted Grand Jury of the 35th Judicial District Court, in Cause Nos. CR30873, CR 30874, CR 30875, CR 30876, CR30877, styled State of Texas vs. Alan Shane Britton. Under the indictment, Judge Britton was charged with Abuse of Official Capacity, a Class A Misdemeanor; Hindering Apprehension or Prosecution, a Class A Misdemeanor; Tampering with a Government Document, a 3rd Degree Felony; Assault Public Servant, a 3rd Degree Felony; and Tampering with a Witness, Family Violence Case, a 3rd Degree Felony.
On December 5, 2025, Judge Britton requested a post-suspension hearing before the Commission pursuant to Rule 10(b) of the Disciplinary Rules for Judges and Judicial Candidates. On December 23, 2025, the Commission convened the virtual post-suspension hearing. Judge Britton appeared, with counsel, and presented argument that Judge Britton’s continued service as the chief executive officer of Brown County would not impair public confidence in the judiciary.
Having considered the Indictment, the testimony of Judge Britton, and the argument of Judge Britton’s counsel, the Commission determined that Judge Britton failed to demonstrate that his continued service would not jeopardize the interests of parties involved in court proceedings over which Judge Britton would preside or impair public confidence in the judiciary. The Commission, therefore, determined that Judge Britton should remain suspended without pay.
Accordingly, its hereby ordered that Judge Alan Shane Britton shall remain suspended, without pay, from the office of County Judge for Brown County, Texas from performing any judicial and/or administrative duties of Brown County Judge, pursuant to the authority contained in Article V, Section 1-a(6)A of the Texas Constitution and Rule 10 of the Disciplinary Rules for Judges and Judicial Candidates, and that such suspension, as amended by this order, shall be effective immediately and shall remain in effect until further order of the Commission. It is furthered ordered that the Commission retains the authority to reconsider this order should additional information not yet received warrant such action.
Britton is on the March 3 Primary ballot along with Patrick Howard and Tom Munson.
