The Davis-Morris Funeral Home building, 800 Center Ave. in Brownwood, will be sold at an auction to be held Tuesday, December 3, at the Brown County Courthouse.

Davis-Morris is now owned by Heritage Funeral Homes, and is known as the Davis-Morris Chapel in Brownwood.  According to the auction notice posted at the Brown County Courthouse, the property is being foreclosed upon by the lender, listed as Incredible Bank, and will be sold by the substitute trustee, listed as Richard H. Hester, Mark Cummings, Dick Vetter, and David Garvin, of Dallas, Texas.  The borrower is listed as Fulton Mercer Corp.  The bank note is dated April 12, 2021.  No minimum bid is listed.

The auction will take place on Tuesday, December 3, at 1:00 p.m.

Dr. Jason Fulton, co-owner of Heritage Funeral Homes, provided the following statement:

“Business operations can present numerous complexities.  Upon acquiring the property in 2021, we were unaware of an existing lease agreement with an adjacent church for the parking lot, which has been contentious.  Additionally, the mortgage lender has imposed a blanket lien on all our holdings.

“Due to financial strains and an ongoing bankruptcy lasting approximately eight months, we are compelled to relinquish this property to secure the company’s future.

“We are actively pursuing a new site, and have submitted an offer, pending confirmation.  Despite these challenges, all pre-arranged funerals will proceed as planned at our Brady location.  Clients can still hold services in Brownwood, and all existing policies remain valid.

“We expect to relocate to a new venue shortly.”
