5 year old child injured in one vehicle accident, Drunk Driving likely the cause

BrownwoodNews – On Tuesday 1/29/19 at approximately 7:40pm Early Police and Fire, as well as Lifeguard EMS, responded to a reported 1 vehicle rollover accident in the 1600 block of Early Blvd.

A white 2002 dodge Ram pickup failed to veer to the right where the highway divides, at which time it lost control and rolled twice. The roadway was closed for approximately a half hour due to the accident and an emergency helicopter landing in the roadway.

The driver ,Kimberly Netherly and her 5-year-old daughter were the occupants of the vehicle. The child was not restrained and ejected from the vehicle during the rollover. The 5-year-old was transported to Cooks Children’s hospital in Fort Worth by Air Evac helicopter, the driver was not injured.

Officer Kelly Marsh could smell a strong odor of alcohol on the driver and believed her to be intoxicated due to her actions and statements. Netherly stated she believed it was 740am and stated she was taking her daughter to school.

Kimberly Netherly was given a field sobriety test, which she failed. Officer Kelly Marsh applied for a blood search warrant which was signed by judge Sam Moss. Netherly was taken to Brownwood Regional Medical Center ER where a blood sample was taken that will be submitted to the DPS lab for analysis.

Netherly was then arrested and taken to the Brown County Jail and charged with Driving while intoxicated with a child passenger under 15 years of age, driving while license invalid, fail to maintain financial responsibility and unrestrained child in a vehicle. The child’s condition is currently unknown but did sustain serious injuries.

Brown County Sheriff’s Office assisted with traffic and closing the highway and DPS Troopers assisted with the investigation.
