Texas Taxpayers to Foot Nebraska’s Medicaid Bill

“The Nebraska Compromise reflects the very worst of backroom dealing — it amounts to outright vote buying, it effectively forces Texas taxpayers to foot Nebraska’s Medicaid bill, and it is constitutionally questionable.

As more than a dozen state attorneys general explained in our letter highlighting this outrageous provision’s significant legal problems, the Nebraska Compromise arbitrarily favors one state to the detriment of 49 others, violates fundamental American notions of fairness, and is inconsistent with basic principles of nondiscrimination that are guaranteed by our constitution.

No public policy goal — no matter how important or challenging it may be — can be allowed to trample the protections and rights guaranteed by our Constitution.

The Texas Attorney General’s Office will explore all available legal options to challenge this provision if it is ultimately passed — and equally important will continue reviewing other aspects of the federal health care legislation that are legally and constitutionally troubling.”
